1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Operator," "you," or "your") and BarBoss LLC, an Oregon limited liability company ("BarBoss," "we," "us," or "our"), governing your access to and use of the BarBoss platform at mybarboss.com (the "Service").
By creating an account, accessing the Service, or clicking "I agree," you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of Service
BarBoss provides a software-as-a-service platform for mobile bar operators and event bartending professionals, including:
- Order management and queue tools
- Guest-facing self-service kiosk functionality
- Order status tracking via unique URLs
- Pre-order menu capabilities
- Host dashboard and event reporting
- Team management and staff coordination
- Analytics and event reporting
BarBoss is a software platform only. We do not provide bartending services, alcoholic beverages, or any physical goods. You are solely responsible for the services you provide to your clients and their guests.
3. Accounts and Registration
3.1 Eligibility
You must be at least 18 years old and legally capable of entering a binding contract to use the Service.
3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@mybarboss.com if you suspect unauthorized access.
3.3 One Account Per Operator
Each business entity may maintain one active operator account unless explicitly authorized by BarBoss in writing. You may not create multiple accounts to circumvent usage limits.
4. Subscriptions and Payment
4.1 Subscription Plans
BarBoss offers subscription plans as described on our pricing page. Plan features, limitations, and pricing are subject to change with notice.
4.2 Free Trial
New accounts receive a 14-day free trial. No credit card is required during the trial. At the end of the trial, your account will be locked until you subscribe. Your data is preserved and restored upon subscription.
4.3 Billing
Subscription fees are billed in advance monthly or annually. Payments are processed by Stripe. By providing payment information, you authorize BarBoss to charge applicable fees to your payment method.
4.4 Failed Payments
If a payment fails, we will notify you by email. Your account may be suspended if payment is not received within 7 days.
4.5 Refunds
All subscription fees are non-refundable except as required by applicable law. If you cancel, you retain access through the end of your current billing period.
4.6 Price Changes
We may change subscription prices with at least 30 days' advance notice. Price changes apply to your next billing cycle after the notice period.
5. Cancellation
5.1 Cancellation by You
You may cancel your subscription at any time through your billing settings or by contacting support@mybarboss.com. Cancellation takes effect at the end of your current billing period.
5.2 Cancellation by BarBoss
We reserve the right to suspend or terminate your account at any time for violation of these Terms, non-payment, or conduct harmful to the Service or other users.
5.3 Effect of Cancellation
Upon cancellation, your access will cease. We retain your data for 30 days following cancellation, after which it may be permanently deleted. Request a data export before cancellation by contacting support@mybarboss.com.
6. Acceptable Use
6.1 Permitted Use
You may use the Service only for lawful purposes in connection with your legitimate mobile bar or event bartending business.
6.2 Prohibited Conduct
You agree not to:
- Use the Service in violation of any applicable law or regulation
- Facilitate illegal alcohol service or service to minors
- Collect or process guest data in violation of privacy laws
- Attempt to gain unauthorized access to the Service or its infrastructure
- Reverse engineer, decompile, or disassemble any portion of the Service
- Resell or transfer your account without written consent from BarBoss
- Use the Service to build a competing product
- Circumvent any usage limits or access controls
6.3 Responsible Alcohol Service
BarBoss is a technology tool and does not control or take responsibility for alcohol service at your events. You are solely responsible for complying with all applicable liquor laws, verifying guest age, and ensuring responsible alcohol service.
7. Guest Data and Privacy
7.1 Your Responsibility as Data Controller
When you use BarBoss to collect information from event guests, you are the data controller responsible for that guest data. BarBoss acts as a data processor on your behalf.
7.2 Guest Notice
You are responsible for providing appropriate notice to guests about data collection at your events and ensuring compliance with applicable privacy laws.
7.3 Data Processing
By using the Service, you authorize BarBoss to process guest data on your behalf as necessary to provide the Service, in accordance with our Privacy Policy.
8. Intellectual Property
8.1 BarBoss Ownership
BarBoss and its licensors own all right, title, and interest in and to the Service. Nothing in these Terms transfers any ownership rights to you.
8.2 License to Use
BarBoss grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service during your subscription term, solely for your internal business purposes.
8.3 Your Content
You retain ownership of all content you upload to the Service. By uploading content, you grant BarBoss a limited license to store, process, and display it solely to provide the Service.

10. Indemnification
You agree to indemnify, defend, and hold harmless BarBoss LLC and its members, officers, employees, and agents from any claims, liabilities, damages, and expenses arising from your use of the Service, violation of these Terms, your alcohol service operations, or your handling of guest data.
11. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes by email or within the Service at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of the State of Oregon, without regard to conflict of law provisions.
12.2 Informal Resolution
Before filing any formal legal claim, you agree to contact us at legal@mybarboss.com and attempt to resolve the dispute informally for at least 30 days.
12.3 Arbitration
Any dispute that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association, conducted in Portland, Oregon or remotely.
